CUSTOMS ACT (CAP 55)

Commencement [Date]

IN EXERCISE of the powers conferred by section 7 of the Customs Act, Cap 55, the Minister makes the following Order —

1 Citation and Commencement

This Order may be cited as the Customs Act Amendment Order 2006 and shall come into effective on the date it is endorsed by the Minister.

2 Interpretation

For the purpose of this Order unless otherwise specified —

"TANGO" means Tuvalu Association of Non-Governmental Organization. "project" means a development for the advancement of the people of Tuvalu.

3 Application

(1) The Minister hereby specifies that exemption of customs duty is applied to goods imported into Tuvalu by the TANGO for the exclusive use and purpose of projects. Such exemption is applicable subject the TANGO provides to the satisfaction of the customs officer the following;

(i) Copy of project proposal,

(ii) Certificate of project acceptance, and

(iii) Relevant documents.

(2) The onus rests upon the TANGO to prove that the goods imported are goods of a project. Made at Funafuti this 10th day of April 2006.
