SUPERIOR COURTS (AMENDMENT) ACT 2016

AN ACT TO AMEND CERTAIN PROVISIONS OF THE SUPERIOR COURTS ACT TO PROVIDE FOR BETTER OPERATIONS OF SUPERIOR COURTS IN TUVALU.

Commencement [11th April 2017]

1 Short Title

This Act may be cited as the Superior Courts (Amendment) Act 2016.

2 Amendment to section 6

Section 6 is amended by inserting the following:

"6A The Chief Justice is responsible for the exercise of the functions of the High Court"

3 Amendment to section 7

Section 7 is amended by inserting a new subsection (3) as follows:

"(3) The Chief Justice is responsible for the exercise by the Court of Appeal of its functions and shall notwithstanding the provisions of subsection 2, preside over any hearings at which he is present."

4 Amendment to section 8

Section 8(2) is amended by inserting "given after consultation with the Chief Justice" after the words "advice of the Cabinet."
