1. Name

These are the Census Rules 1961.

3. Interpretation

In these Rules —

"dwelling" means any building or erection, whether permanent or temporary, which is wholly or partly used for human habitation; and includes a vessel at any island of Tokelau, or on a passage between any of those islands;
"night of the census" means the night between sunset on the day appointed under these Rules for the census and sunrise on the following day.

4. Frequency

(1) The census of population of Tokelau shall be taken in the year 1961 and in every fifth year thereafter.

(2) The day for the taking of any census under these Rules shall be appointed by the Council for the Ongoing Government and notified in such manner as it thinks fit.

(3)

(i) There shall be a population census taken in December 2004 and every third year thereafter.
(ii) The census shall provide a village population count of:

• (I) All Tokelauans who have, in the previous 12 months, been resident in that village for at least three months;
• (II) All non-Tokelauans who are permanent residence of Tokelau living in the village for not less than 5 years immediately before the date of the census;
• (III) All permanent residents of the village who are studying outside Tokelau;
• (IV) All Tokelauan residents of the village employed in the Tokelau Public Service outside Tokelau.

5. Duties for officers

For the purpose of taking the census the Council for the Ongoing Government may assign duties to such officers as are required.

6. Method

The census shall be taken by means of the schedules referred to in rule 9 and containing particulars which shall be furnished by the occupier or person in charge of every dwelling with respect to every person who resided in the dwelling on the night of the census and who was alive at midnight or who, not being already included in any other census schedule, arrived in that dwelling after midnight on the night of the census and before midnight on the next following night.

7. Duties of occupiers

The occupier or person in charge of every such dwelling shall ensure that the particulars required by the schedules are furnished with respect to —

(i) every person who resided in the dwelling on the night of the census and was alive at midnight; and
(ii) every person who arrived at the dwelling after midnight on that night and before midnight on the next following night and was not included in any other census schedule.

8. Duties of non-occupiers

(1) Every person (not being the occupier or person in charge of the dwelling) —

(i) shall furnish to the occupier or person in charge of the dwelling the particulars necessary to complete the household schedule; or
(ii) if he is not a member of the family of the occupier or person in charge, shall either furnish those particulars to the occupier or person in charge or complete a personal schedule and deliver it to the occupier or person in charge, who shall insert in the household schedule the name of the person completing the personal schedule.

(2) The person completing a personal schedule may, if he so wishes, enclose it in an envelope endorsed with his name, and seal the envelope before delivery to the occupier or person in charge, and if the occupier or person in charge opens any such envelope he commits an offence and is liable to a fine not exceeding 2 penalty units.

9. Particulars

The particulars, which shall be obtained by means of the schedules with reference to the night of the census, shall be as follows —

(1) Enumerators' Compilation Schedule

• (i) name of village;
• (ii) number of schedule for dwelling;
• (iii) name of head of household;
• (iv) date when enumerated;
• (v) date when checked;
• (vi) number of persons in dwelling (males and females).

(2) Household or Personal Schedule

• (i) name in full;
• (ii) sex;
• (iii) age;
• (iv) total number of children living or dead born to every female 15 years of age or over and her age when first child was born;
• (v) marital status;
• (vi) place of birth;
• (vii) date of birth;
• (viii) racial origin;
• (ix) religion;
• (x) occupation.

10. Religion

If any person objects to stating his religion, an entry or statement of objection shall be sufficient for the purpose of the census.

11. Questions by officers

Every officer appointed for the purpose of the census may ask such questions and conduct such inquiries as are necessary to obtain or to verify the particulars specified in rule 9.

12. Further instruction

In any case in which the prescription of particulars specified is insufficient to indicate the nature of the information to be furnished, the Council for the Ongoing Government may direct by means of instructions in a census schedule or sub-enumeration book the precise nature of the particulars required.

13. Neglect or refusal

Every person commits an offence who neglects or refuses to furnish any census schedule or to answer any questions lawfully put to him for the purposes of the census, or who knowingly makes any statements or gives any answer untrue in any material particular required by these Rules, and is liable to a fine not exceeding 2 penalty units.

14. Destruction, mutilation, or defacement

Every person commits an offence who without lawful authority destroys, mutilates, or defaces a census schedule or other census document or record, and is liable to a fine not exceeding 2 penalty units.

15. Confidentiality

Every person commits an offence who, whether or not he is an officer appointed to any duty in connection with the census, divulges or makes use of any information obtained pursuant to these Rules, except as required for the preparation of statistics from the data obtained at the census, and is liable to a fine not exceeding 2 penalty units.

16. Hindrance or obstruction

Every person commits an offence who hinders or obstructs any officer in pursuance of his duty under these Rules, and is liable to a fine not exceeding 0.5 penalty units.

17. Data and Statistics

The Council for the Ongoing Government may prepare from the data obtained at the census such statistics as may be required for its purposes, and may publish such statistics and such comments thereon as it considers necessary or advisable.
