AN ACT TO AMEND SECTION 9 OF THE PROVINCIAL GOVERNMENT ACT 1997; TO PERMIT PROVINCIAL ELECTIONS TO BE HELD ON A DATE OTHER THAN ON THE FOURTH ANNIVERSARY OF THE PREVIOUS ORDINARY ELECTION.


ENACTED by the National Parliament of Solomon Islands.


PROVINCIAL GOVERNMENT (AMENDMENT) ACT 2014


1. This Act may be cited as the Provincial Government (Amendment) Act 2014, and shall come into force on the date that it is published in the Gazette.


2. Section 9 of the principal Act is amended by deleting subsection (1) and substituting the following -


"(1) Subject to subsection (2) an ordinary election of members of a Provincial Assembly shall –


(a) be held on the fourth anniversary of the date of the office of the previous election of members (whether it was an ordinary election or an election held under section 10(4)); or


(b) be held on any other date that the Minister may appoint by Order published in the Gazette if the Minister -


(i) is satisfied that such action is necessary and in the public interest;


(ii) has consulted with the Premier of the relevant province; and


(iii) the date of the election is not more than 60 days before or after the date that the election would otherwise be held under paragraph (a) of this subsection."
