AN ACT


entitled


Pacific Games (2015) Authority (Amendment) Act 2012,


Being an Act to amend the Pacific Games (2015) Authority Act 2011, and for related purposes,


MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with the advice of the Minister.


1. INTERPRETATION (AMENDMENT OF SECTION 2).


Section 2 of the Principal Act is amended by repealing the definition of "Minister" and replacing it with the following:


""Minister" means the minister responsible for the 2015 Pacific Games.".


2. REPEAL AND REPLACEMENT OF SECTION 8.


Section 8 of the Principal Act is repealed and replaced with the following:


"8. ESTABLISHMENT AND MEMBERSHIP OF THE BOARD.


(1) The Authority shall be managed by a board which shall consist of not less than 7 and not more than10 members, being -


(a) a nominee of the Minister from PNG Sports Foundation; and


(b) a nominee of the Governor of National Capital District from the National Capital District Commission; and


(c) a nominee from the business community nominated by the Minister; and


(d) the President of the PGA or his nominee; and


(e) the Secretary General of the PGA or his nominee; and


(f) the Treasurer of the PGA or his nominee; and


(g) the President of the PGC or his nominee.


"(2) If additional members are required, the parties (State, PGA and PGC) may, by mutual agreement, co-opt members as and when required.".


3. CHAIRMAN AND DEPUTY CHAIRMAN (AMENDMENT OF SECTION 9).


Section 9 of the Principal Act is amended by repealing Subsection 1 and replacing it with the following:


"(1) The PGA, in close consultation with the Minister and the other parties to the host agreement, shall appoint one of the members of the board to be the Chairman of the Authority.".


4. REPEAL AND REPLACEMENT OF SECTION 16.


Section 16 of the Principal Act is repealed and replaced with the following:


"16. APPOINTMENT OF VIEC.


The Minister responsible for the 2015 Pacific Games shall appoint suitably experienced and qualified individuals to form the VIEC.".


5. REPEAL AND REPLACEMENT OF SECTION 17.


Section 17 of the Principal Act is repealed and replaced with the following:


"17. FUNCTIONS OF VIEC.


(1) The VIEC is charged with the responsibility of providing all -


(a) sporting venues; and


(b) associated fixed equipment, overlays, village accommodation; and


(c) other games infrastructure as required or prescribed in the PGC documents,


for the successful staging of the 2015 Pacific Games.


"(2) Part VII of the Public Finance (Management) Act 1995 (as amended) applies to VIEC.".


6. NEW SECTION 17A.


The Principal Act is amended by inserting a new section after Section 17 as follows:


"17A. REPORTING.


The VIEC shall furnish quarterly reports and such other reports, as and when required, to the Authority.".
