Repeal and replacement of Subsections (3) and (4) (Amendment of Section 39).

AN ACT

entitled

Public Finances (Management)(Amendment) Act 2015,

Being an Act to amend the Public Finances (Management) Act 1995,

MADE by the National Parliament.

REPEAL AND REPLACEMENT OF SUBSECTIONS (3) AND (4) (AMENDMENT OF SECTION 39).

CENTRAL SUPPLY AND TENDERS BOARD (AMENDMENT OF SECTION 39).

Section 39 of the Principal Act is amended by repealing Subsections (3) and (4) and replacing them with the following new subsections:

"(3) The Central Supply and Tenders Board shall consist of the following seven members:

(a) the State Solicitor or the Deputy State Solicitor as alternate, ex officio; and

(b) the Departmental Head of the Department responsible for financial matters or the Deputy Departmental Head to be his alternate, ex officio; and

(c) the Departmental Head of the Department responsible for works matters or the Deputy Departmental Head to be his alternate, ex officio; and

(d) a representative of the Papua New Guinea Chamber of Commerce; and

(e) a representative from the Papua New Guinea Institute of Engineers; and

(f) a representative from the Papua New Guinea Institute of Accountants; and

(g) an independent member being an imminent person who has relevant experience, knowledge and understanding of the industry.

(4) Where the Minister, upon advice, agrees for the nominations for members of the Central Supply and Tenders Board under Subsection (3)(d) - (g) from a list of three nominees submitted by each organisation concerned, the nominee who is approved –

(a) shall be appointed by the Minister as a member of the Central Supply and Tenders Board for a term of three years; and

(b) shall hold office on such terms and conditions as determined by the Minister.".
