AN ACT


entitled


National Research Institute (Amendment) Act 2009,


Being an Act to amend the National Research Institute Act (Chapter 165),


MADE by the National Parliament to be deemed to have come into operation on 15 November 1994.


1. ESTABLISHMENT OF THE INSTITUTE (AMENDMENT OF SECTION 2).


Section 2 of the Principal Act is amended by repealing Paragraph (a).


2. OBJECT'S OF THE INSTITUTE (AMENDMENT OF SECTION 5).


Section 5 of the Principal Act is amended by repealing Paragraph (h).


3. TRANSFER OF ASSETS, ETC.,


(1) All assets, property, liabilities and duties of the Institute immediately before the coming into operation of this Act in so far as relating to the former Institute of Papua New Guinea Studies and to the functions of the Institute under Section 5(h) of the Principal Act (which Paragraph (h) is repealed by this Act) are, on that coming into operation, transferred to and become assets, property, liabilities and duties of the National Cultural Commission established under the National Cultural Commission Act 1994.


(2) Where any property referred to in Subsection (1) is land registered under the Land Registration Act (Chapter 191), the Registrar of Titles shall, without formal transfer and without fee, on application in that behalf by the National Cultural Commission, enter or register the National Cultural Commission in the register kept under that Act, and on entry and registration grant a certificate of title, lease or other instrument evidencing title to that land.


3. TRANSFER OF STAFF.


All officers and employees of the Institute, whose principal duties immediately before the coming into operation of this Act relate to the functions of the Institute under Section 5(h) of the Principal Act (which Paragraph (h) is repealed by this Act) are, on that coming into operation, transferred to and become officers and employees of the National Cultural Commission in equivalent offices and at equivalent levels to those which they held in the Institute.


4. TRANSFER OF CONTRACTS.


All contracts and agreements (other than, subject to Section 4, contracts of employment) entered into, made with or addressed to the Institute, in so far as relating to the former Institute of Papua New Guinea Studies and to the functions of the Institute under Section 5(h) of the Principal Act (which Paragraph (h) is repealed by this Act) that were, immediately before the coming into operation of this Act binding on and of full force and effect against or in favour of the Institute are, on that coming into operation binding on and of full force and effect against or in favour of the National Cultural Commission established under the National Cultural Commission Act 1994 as if the National Cultural Commission had been a party to them or entitled to the benefit of them.


6. ACTIONS NOT TO ABATE.


Where, immediately before the coming into operation of this Act, any action, arbitration or proceedings relating to the former Institute of Papua new Guinea Studies or to the functions of the Institute of Papua New Guinea Studies or to the functions of the Institute under Section 5(h) of the Principal Act (which Paragraph (h) is repealed by this Act) was pending or existing by, against or in favour of the institute, it does not, on the coming into operation of this Act, abate or discontinue but may be prosecuted, continued and enforced by, against or in favour of the National Cultural Commission established under the National Cultural Commission 1994.
