ARRANGEMENT OF SECTIONS.

1. The Establishment and Operation of the Road Fund (Amendment of Section 30).
2. New Section 30A.

"30A. SAVINGS AND TRANSITIONAL.".

An Act

entitled

National Roads Authority (2013 Budget) (Amendment) Act 2012,

Being an Act to amend the National Roads Authority Act 2003,

MADE by the National Parliament and deemed to have come into operation on 1 January 2011.

1. THE ESTABLISHMENT AND OPERATION OF THE ROAD FUND (AMENDMENT OF SECTION 30).

Section 30 of the Principal Act is amended -

(a) in Subsection (1B) by repealing the words "Internal Revenue Commission" and replacing them with the following words:-

"Papua New Guinea Customs Service"; and

(b) in Subsection (1C) –

(i) by repealing the words "Internal Revenue Commission" and replacing them with the following:-

"Papua New Guinea Customs Service"; and

(ii) by repealing the words "Commissioner General of Internal Revenue" and replacing them with the following words:-

"Commissioner of the Papua New Guinea Customs Service".

2. NEW SECTION 30A.

The Principal Act is amended by inserting the following new section:

"30A. SAVINGS AND TRANSITIONAL.

(1) Where, immediately before the coming into operation of this amendment, any action done by the Commissioner General in terms of transfers pursuant to the trust instruments established for the purposes of the road fund established under Section 30, that action does not, on the coming into operation, abate or discontinue, and is not in any way affected by the amendment in Section 1 to invalidate the transfers.

(2) Notwithstanding Subsection (1), the Commissioner of the Papua New Guinea Customs Services is responsible for the administration, accounting and reporting of the trust accounts from the financial years 1 January 2011 to 31 December 2012.".
