AN ACT


entitled


Judges' Pensions (Amendment) Act 2015,


Being an Act to amend the Judges' Pensions Act 1997 and for related purposes,


MADE by the National Parliament.


1. INTERPRETATION (AMENDMENT OF SECTION 1).


Section 1 of the Principal Act is amended by –


(a) deleting the semi colon at the end of Paragraph (b) in the definition of "Judge" and inserting a comma in its stead and inserting the following words after Paragraph (b) as follows:


"and includes a Chief Justice or a Deputy Chief Justice or a Judge of the National Court or the Supreme Court who has died or retired before the coming into operation of the Principal Act and who is or was a citizen of Papua New Guinea at the time of his death or retirement;"; and


(b) inserting a new definition after the definition of "retired judge" as follows:


"retired" and "retirement" have a meaning that corresponds to that of "retires" and "retirement" in the Principal Act;".


2. NEW SECTION 1A.


The Principal Act is amended by inserting a new section after Section 1 as follows:


"1A. APPLICATION.


(1) The provisions of the Judges' Pensions Act 1997 apply in respect of a widow of a judge who died or retired before the coming into operation of the Principal Act, as if that Act was in operation at the time of that death or retirement.


(2) The sum of a pension accrued and owing to a widow by the operation of Subsection (1) may be paid as a lump sum or as a bonus on the pension payable on and from the day of commencement of this Act.


(3) In calculating the amount of pension accrued and owing, one must take into consideration any ex gratia or other payment already made to the widow under any other law.".
