AN ACT


entitled


Crocodile Trade (Protection)(Amendment) Act 2014,


Being an Act to amend the Crocodile Trade (Protection) Act (Chapter 213),


MADE by the National Parliament to come into operation on the same day as the Conservation and Environment Protection Authority Act 2014 comes into operation.


1. INTERPRETATION (AMENDMENT OF SECTION 1).


Section 1 of the Principal Act is amended by inserting after the definition of "acquire" the following new definition:


""Authority" means the Conservation and Environment Protection Authority established by the Conservation and Environment Protection Authority Act 2013;".


2. LICENCES (AMENDMENT OF SECTION 5).


Section 5 of the Principal Act is amended in Subsections (1), (4), (5), (6), (8) and (9), by repealing the words "the Minister or his delegate" and replacing them with the following words:


"the Conservator".


3. CONDITIONS OF LICENCE (AMENDMENT OF SECTION 6).


Section 6 of the Principal Act is amended in Subsection (5) by repealing the words "the Minister or his delegate" and replacing them with the following words:


"the Conservator".


4. CANCELLATION (AMENDMENT OF SECTION 7).


Section 7 of the Principal Act is amended by repealing the words "the Minister or his delegate" and replacing them with the following words:


"the Conservator".


5. CLOSED SEASONS (AMENDMENT OF SECTION 10).


Section 10 of the Principal Act is amended in Subsection (1) by inserting after the words "The Minister" the following words and symbol:


", acting on the advice of the Conservator,".


6. FORFEITURE OF CROCODILES (AMENDMENT OF SECTION 15).


Section 15 of the Principal Act is amended -


(a) in Subsection (1) by repealing the words "the property of the State" and replacing them with the following words:


"the property of the Authority"; and


(b) by repealing Subsection (2); and


(c) in Subsection (3) by repealing the word "Department" and replacing it with the word "Authority".


7. EXPORT OF CROCODILES (AMENDMENT OF SECTION 17).


Section 17 of the Principal Act is amended in Subsection (1) by repealing the words "the Minister or his delegate" and replacing them with the following words:


"the Conservator".


8. APPEALS (AMENDMENT OF SECTION 18).


Section 18 of the Principal Act is amended by repealing the words "the Minister, whose decision is final" and replacing them with the following words:


"a court of competent jurisdiction".


9. REPEAL OF SECTION 21.


Section 21 of the Principal Act is repealed.


10. LEVY (AMENDMENT OF SECTION 24).


Section 24 of the Principal Act is amended by repealing Subsection (1) and replacing it with the following new subsection:


"(1) The holder of a licence to export crocodiles under this Act shall pay to the Authority a levy on crocodiles exported by him at a rate fixed from time to time by the Minister, acting on the advice of the Authority, by notice in the National Gazette.".
