ARRANGEMENT OF SECTIONS.

1. New Section 4A.

"4A. APPOINTMENT OF COUNSEL AND TECHNICAL AND PROFESSIONAL EXPERTS TO ASSIST THE COMMISSION"

2. Penalty for failing to attend or produce documents (Amendment of Section 9).
3. Penalty for refusing to be sworn or give evidence (Amendment of Section 10).
4. Contempt of Commission (Amendment of Section 11).
5. Preservation of secrecy (Amendment of Section 12).


AN ACT

entitled

Being an Act to amend the Commissions of Inquiry Act (Chapter) 31,

MADE by the National Parliament.

  1. NEW SECTION 4A.

The Principal Act is amended by inserting after Section 4 the following new section:-

"4A. APPOINTMENT OF COUNSEL AND TECHNICAL AND PROFESSIONAL EXPERTS TO ASSIST THE COMMISSION.
(1) The Minister may appoint one or more counsel to assist the Commission in the performance of its duties.
"(2) Where the Minister is of the opinion that the subject of an inquiry warrants it, he may appoint one or more persons with appropriate technical or professional expertise to assist the Commission.".
  1. PENALTY FOR FAILING TO ATTEND OR PRODUCE DOCUMENTS (AMENDMENT OF SECTION 9).

Section 9(1) of the Principal Act is amended by repealing the penalty clause and replacing it with the following:-

"Penalty: A fine not exceeding K5,000.00 or imprisonment for a term not exceeding two years, or both.".
  1. PENALTY FOR REFUSING TO BE SWORN OR GIVE EVIDENCE (AMENDMENT OF SECTION 10).

Section 10 of the Principal Act is amended by repealing the penalty clause and replacing it with the following:-

"Penalty: A fine not exceeding K5,000.00 or imprisonment for a term not exceeding two years or both.".
  1. CONTEMPT OF COMMISSION (AMENDMENT OF SECTION 11).

Section 11 of the Principal Act is amended by repealing the penalty clause and replacing it with the following:-

"Penalty: A fine not exceeding K5,000.00 or imprisonment for a term not exceeding two years, or both.".
  1. PRESERVATION OF SECRECY (AMENDMENT OF SECTION 12).

Section 12 of the Principal Act is amended by repealing the penalty clause and replacing it with the following:-

"Penalty: A fine not exceeding K5,000.00 or imprisonment for a term not exceeding two years, or both.".
