AN ACT

entitled

Claims By and Against the State (Amendment) Act 1992,

Being an Act to amend the Claims By and Against the State Act (Chapter 30),

MADE by the National Parliament.

1. NEW SECTION 2A.

The Principal Act is amended by inserting after Section 2 the following new section:-

"2A. SUITS AGAINST THE HEAD OF STATE.
A person making a claim against the Head of State, or Governor-General, acting on advice, shall, in the proceedings, make such claim against the Attorney-General who shall be the nominal defendant on behalf of the Head of State and Governor-General.".

2. SUITS BY STATE (AMENDMENT OF SECTION 3).

Section 3 of the Principal Act is amended -

(a) in Paragraph (a), by repealing the words "Principal Legal Adviser" and replacing them with the following:-

• "Attorney-General"; and

(b) in Paragraph (b) (i), by repealing the words "Principal Legal Adviser" and replacing them with the following;-

• "Attorney-General".

3. SERVICE OF PROCESS WHERE STATE IS A PARTY (AMENDMENT OF SECTION 4).

Section 4 of the Principal Act is amended -

(a) by repealing Paragraph (a) and replacing it with the following:-

• "(a) on an officer appointed for the purpose by the Attorney-General by notice in the National Gazette; or"; and

(b) by repealing Paragraph (b) and replacing it with the following:-

• (b) in respect of a suit brought in a District Court, on an officer appointed for the purpose by the Attorney-General by notice in the National Gazette.".
