Constitutional Amendment No. 17 - Further Provisions relating to the Provincial Governments and Local-level Governments, 1995

Constitutional Amendment No. 17 - Further Provisions relating to the Provincial Governments and Local-level Governments


Certified on: 22.01.1996


Being a Law to alter the Constitution,

MADE by the National Parliament to come into operation -

(a) in so far as relating to all provinces other than Bougainville Province - to be deemed to have come into operation on 19 July 1995; and
(b) in so far as relating to Bougainville Province - on the day fixed for the return of the writs for the general election held next after certification of this Law.
  1. CONSTITUTION, FUNCTIONS, ETC, OF PROVINCIAL GOVERNMENTS AND LOCAL-LEVEL GOVERNMENTS (AMENDMENT OF SECTION 187C).

Section 187C(2) of the Constitution is amended by repealing Paragraph (a) and replacing it with the following -

"(a) a mainly elective (elected directly or indirectly), legislature with such powers as are conferred by law; and".
  1. INTER-GOVERNMENTAL RELATIONS (AMENDMENT OF SECTION 187H).

Section 187H of the Constitution is repealed and is replaced with the following:-

"187H - NATIONAL ECONOMIC AND FISCAL COMMISSION.
(1) An Organic Law shall make provision for and in respect of a National Economic and Fiscal Commission.
"(2) The Commission, in addition to any other functions prescribed by an Organic Law, shall -

(a) assess and monitor the economic and fiscal policies of the National Government, Provincial Governments and Local-Level Governments; and

(b) advise and recommend to the National Executive Council, appropriate policies; and
(c) make recommendations to the National Executive Council and to the National Parliament on the financial arrangements and allocation of grants -
  1. THE SALARIES AND REMUNERATION COMMISSION (AMENDMENT OF SECTION 216A).

Section 216A(3) of the Constitution is amended by repealing from Paragraph (b) the words in brackets "(including any Speakers appointed from outside the Assemblies)" and replacing them with the words "and members of Local-level Governments".

CERTIFICATE UNDER SECTION 14.

I, BEN OKORRO, Acting Speaker of the National Parliament, hereby certify that the requirements of Section 14(1), (2) and (3) of the Constitution were complied with in respect of the Constitutional Amendment No. 17 - Further Provisions relating to Provincial Governments and Local-level Governments and that the law was made by the National Parliament as follows:-

(a) the first vote was taken on 12 October 1995 when the number of seats in the National Parliament was 109 and those voting for the proposal were 84 and none voted against the proposal; and
(b) the second vote was taken in 13 December 1995 when the number of seats in the National Parliament was 109 and those voting for the proposal were 82 and none voted against the proposal.
