Bookmaking (Penalties Amendment) Act 2001

Bookmaking (Penalties Amendment) Act 2001.

ARRANGEMENT OF SECTIONS.

1. Minister may grant licences (Amendment of Section 6).
2. Deposits by licensed bookmakers (Amendment of Section 10).
3. Betting tickets to be purchased from Commissioner General (Amendment of Section 16).
4. Record of bets (Amendment of Section 17).
5. Offences relating to turnover tax (Amendment of Section 27).
6. Licensed bookmakers not to do certain things (Amendment of Section 28).
7. Bookmakers to comply with act (Amendment of Section 29).
8. Restriction on betting (Amendment of Section 30).
9. Off-course betting on race days (Amendment of Section 31).
10. Persons under 18 years not permitted to enter licensed premises (Amendment of Section 32).
11. Drinking not permitted on licensed premises (Amendment of Section 33).
12. Other offences by licensed bookmakers (Amendment of Section 34).
13. Obstruction (Amendment of Section 39).
14. False or misleading information in application (Amendment of Section 40).
15. Regulations (Amendment of Section 42).


AN ACT

entitled

Bookmaking (Penalties Amendment) Act 2001,

Being an Act to amend the Bookmaking Act (Chapter 265),

MADE by the National Parliament to come into operation on passage of the Bill.

  1. MINISTER MAY GRANT LICENCES (AMENDMENT OF SECTION 6).

Section 6 of the Principal Act is amended in Subsection (4) by repealing the penalty clause and replacing it with the following:—

"Penalty: A fine of not less than K1,000.00 and not exceeding K10,000.00.".
  1. DEPOSITS BY LICENSED BOOKMAKERS (AMENDMENT OF SECTION 10).

Section 10 of the Principal Act is amended in Subsection (1)(b) by repealing the figure "K50,000.00" and replacing it with the following:—

"K100,000.00.".
  1. BETTING TICKETS TO BE PURCHASED FROM COMMISSIONER GENERAL (AMENDMENT OF SECTION 16).

Section 16 of the Principal Act is amended in Subsection (3) by repealing the penalty clause and replacing it with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. RECORD OF BETS (AMENDMENT OF SECTION 17).

Section 17 of the Principal Act is amended in Subsection (2) by repealing the penalty clause and replacing it with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. OFFENCES RELATING TO TURNOVER TAX (AMENDMENT OF SECTION 27).

Section 27 of the Principal Act is amended —

(a) in Subsection (1) by repealing the penalty clause and replacing it with the following:—
(b) in Subsection (3) by repealing the penalty clause and replacing it with the following:—
  1. LICENSED BOOKMAKERS NOT TO DO CERTAIN THINGS (AMENDMENT OF SECTION 28).

Section 28 of the Principal Act is amended in Subsection (1) by repealing the penalty clause and replacing them with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.",
  1. BOOKMAKERS TO COMPLY WITH ACT (AMENDMENT OF SECTION 29).

Section 29 of the Principal Act is amended by repealing the penalty clause and replacing them with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. RESTRICTION ON BETTING (AMENDMENT OF SECTION 30).

Section 30 of the Principal Act is amended by repealing the penalty clause and replacing them with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. OFF-COURSE BETTING ON RACE DAYS (AMENDMENT OF SECTION 31).

Section 31 of the Principal Act is amended by repealing the penalty clause and replacing them with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. PERSONS UNDER 18 YEARS NOT PERMITTED TO ENTER LICENSED PREMISES (AMENDMENT OF SECTION 32).

Section 32 of the Principal Act is amended —

(a) in Subsection (1) by repealing the penalty clause and replacing it with the following:—
(b) in Subsection (2) by repealing the penalty clause and replacing it with the following:—
  1. DRINKING NOT PERMITTED ON LICENSED PREMISES (AMENDMENT OF SECTION 33).

Section 33 of the Principal Act is amended —

(a) in Subsection (1) by repealing the penalty clause and replacing them with the following:—
(b) in Subsection (2) by repealing the penalty clause and replacing it with the following:—
  1. OTHER OFFENCES BY LICENSED BOOKMAKERS (AMENDMENT OF SECTION 34).

Section 34 of the Principal Act is amended by repealing the penalty clause and replacing them with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. OBSTRUCTION (AMENDMENT OF SECTION 39).

Section 39 of the Principal Act is amended by repealing the penalty clause and replacing it with the following:—

"Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".
  1. FALSE OR MISLEADING INFORMATION IN APPLICATION (AMENDMENT OF SECTION 40).

Section 40 of the Principal Act is amended by repealing from the penalty clause the words and figures "A fine not exceeding K1,000.00" and replacing them with the following:—

"A fine of not less than K500.00 and not exceeding K5.000.00.".
  1. REGULATIONS (AMENDMENT OF SECTION 42).

Section 42 of the Principal Act is amended by repealing the figure "K200.00" and replacing it with the following:—

"K500.00".
