BOOKMAKING (2007 BUDGET AMENDMENT) ACT 2006

ARRANGEMENT OF SECTIONS.


1. Betting tickets to be purchased from the Commissioner General (Amendment of Section 16).
2. New Section 28A:-


"28A. PRINTER APPROVED BY COMMISSIONER GENERAL NOT TO DO CERTAIN THINGS.".

AN ACT


entitled


Bookmaking (2007 Budget Amendment) Act 2006,


Being an Act to amend the Bookmaking Act (Chapter 265),


MADE by the National Parliament to come into operation on 1 January 2007.


1. BETTING TICKETS TO BE PURCHASED FROM THE COMMISSIONER GENERAL (AMENDMENT OF SECTION 16).


Section 16 of the Principal Act is amended –


(a) by inserting after the words "Commissioner General" (whenever appearing) the following:–


"or a printer approved by the Commissioner General,"; and


(b) in Subsection (1) by repealing the words "prescribed price" and substituting the following:–


"price approved by the Commissioner General"; and


(c) by inserting the following new subsection after Subsection (3):–


"(4) A printer approved by the Commissioner General who sells betting tickets to an unlicensed bookmaker is guilty of an offence


Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.".


2. NEW SECTION 28A.


The Principal Act is amended by inserting after Section 28 the following new section:–


"28A. PRINTER APPROVED BY COMMISSIONER GENERAL NOT TO DO CERTAIN THINGS.


"(1) A printer approved by the Commissioner General under Section 16 who, except with the approval of the Commissioner General –


(a) enters into a partnership with respect to the printing business carried on under the approval with a person whose name is not endorsed with that approval; or


(b) makes an arrangement or enters into an agreement with a person by which that person becomes entitled to a share in the profits of that business,


is guilty of an offence .


Penalty: A fine of not less than K500.00 and not exceeding K5,000.00.


"(2) An approval of the Commissioner General given under Subsection (1) may be given generally with respect to all transactions of a type specified in the approval or specifically with respect to a particular transaction.


"(3) The criteria for granting approval under this section shall be determined by the Commissioner General and published in the National Gazette.".
