The Court being advised by counsel for the parties that the appellant in this case, Vicente R. Matagolai, died in December of 1974, during pendency of this appeal, and that this case was thereby rendered moot; and

Now therefore it is hereby ordered that this appeal is dismissed, with each party to bear its own costs incurred with respect to the appeal.
