This matter came before the court for hearing on the motion of the appellee to dismiss the appeal for lack of jurisdiction and it appearing to the court that the appellant was personally served with notice on August 4, 1970, at 4:10 p.m. at Room 106, USCAR Building, Machinato, Okinawa, and that the appellant was also served notice of this hearing by registered mail received by Seiei Nagahama, attorney for the appellant, on August 5, 1970, the appellant not appearing, the court proceeded with the hearing of this matter and after having heard arguments of counsel for the appellee is of the opinion that said motion is well taken and the court hereby Orders that the appeal filed herein be dismissed.
