PARLIAMENTARY SALARIES AND ALLOWANCES ACT 1995

AN ACT

To provide for salaries and allowances for Members of Parliament and Members of Cabinet

(Certified: 27th Sept., 1995)

Enacted by the Parliament of Nauru as follows:

SHORT TITLE

1 This Act may be cited as the Parliamentary Salaries and Allowances Act 1995.

COMMENCEMENT

2. This Act shall be deemed to have come into effect on the fifteenth day of November 1992.

REPEAL

3. Subject to the next succeeding section, the Parliamentary Salaries and Allowances Act 1991 is hereby repealed.

SAVING

4. Insofar as any salary or allowances may be lawfully due and owing to any person pursuant to the Parliamentary Salaries and Allowances Act 1991, that Act shall be deemed to remain in force for such time and to such extent only as shall be necessary to enable any such salary or allowances to be paid to such person.

ALLOWANCES TO MEMBERS OF PARLIAMENT

5. (1) Every Member of Parliament shall be entitled to receive a Member's allowance at the rate of twelve thousand and fifty one dollars per annum.

(2) Every Member of Parliament, other than the President, Ministers, the Speaker, the Deputy Speaker and any Minister acting as President, shall be entitled to receive an entertainment allowance at the rate of six per cent per annum of Member's allowance provided in subsection (1) of this section.

ALLOWANCES TO SPEAKER AND DEPUTY SPEAKER

6. (1) The Speaker shall be entitled to receive a Speaker's allowance at the rate of twenty thousand and eighty-five dollars per annum.

(2) The Speaker shall be entitled to receive an entertainment allowance at the rate of five percent per annum of the Speaker's allowance provided in subsection (1) of this section.

(3) The Deputy Speaker shall be entitled to receive a Deputy Speaker's allowance at the rate of one thousand eight hundred and three dollars per annum.

(4) The Deputy Speaker shall be entitled to receive an entertainment allowance at the rate of twenty percent per annum of the Deputy Speaker's allowance provided in subsection (3) of this section.

REVISED ALLOWANCES TO SPEAKER AND DEPUTY SPEAKER

7. (1) Notwithstanding anything contained in the provisions of preceding Sections 2 and 6, the Speaker and Deputy Speaker shall be entitled to allowances given hereunder with effect from first day of July Nineteen hundred and ninety five:

(2) The Speaker shall be entitled to receive a Speaker's allowance at the rate of twenty eight thousand one hundred and nineteen dollars per annum;

(3) The Speaker shall be entitled to receive an entertainment allowance at the rate of five percent per annum of the Speaker's allowance provided in subsection (2) of this section;

(4) The Deputy Speaker shall be entitled to receive an allowance at the rate of fourteen thousand and sixty dollars per annum.

(5) The Deputy Speaker shall be entitled to receive an entertainment allowance at the rate of five percent per annum of the Deputy Speaker's allowance as in subsection (4) of this section.

SALARY AND ALLOWANCES OF THE PRESIDENT

8. (1) The President shall be entitled to receive a salary at the rate of forty two thousand one hundred and twenty seven dollars per annum.

(2) The President shall be entitled to receive an entertainment allowance at the rate of twenty percent per annum of his salary provided for in subsection (1) of this section.

(3) A Minister appointed to perform the duties and exercise the functions of the President shall be entitled during the period of his appointment to receive an acting allowance at the rate of twenty five per cent per annum of the salary of the President provided for in subsection (1) of this section and an entertainment allowance at the rate of twenty five percent per annum of such allowance payable to the President pursuant to subsection (2) of this section.

SALARY AND ALLOWANCES OF THE MINISTERS

9. (1) A Minister shall be entitled to receive a salary at the rate of twenty eight thousand one hundred and nineteen dollars per annum.

(2) A Minister shall be entitled to receive an entertainment allowance at the rate of six percent per annum of his salary provided for in subsection (1) of this section.

SALARIES AND ALLOWANCES UNDER SECTIONS 6, 7, 8, AND 9 TO BE ADDITIONAL TO SECTION 5

10. The salaries and allowances provided for in sections 6, 7, 8 and 9 shall be in addition to those provided in section 5.

CHARGE ON THE TREASURY FUND

11. The amounts to which a person is entitled under this Act shall be paid from and are charged upon the Treasury fund.

REVIEW OF SALARIES AND ALLOWANCES

12. The parliamentary salaries and allowances provided in this Act shall be the subject of review commencing before the end of June 1996 and thereafter, before the end of every succeeding period of three years.

REGULATIONS

13. Cabinet may from time to time make regulations to determine benefits, allowances and entitlements to Members of Parliament, the Speaker, the Deputy Speaker, the President and Ministers, other than the salaries and allowances provided herein.
