Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Legal Practitioners (Amendment) Act 2018.

2 Commencement

This Act commences upon certification by the Speaker.

3 Amendment of Legal Practitioners Act 1973

The Legal Practitioners Act 1973 is amended by the provisions of this Act.

4 Amendment of section 7A

Section 7A is omitted and substituted as follows:

7A Exemption of Government Lawyers

(1) The provisions of admission in this Act shall not apply to the Secretary for Justice and Border Control, Solicitor General, Director of Public Prosecutions, Director of the Office of the Public Legal Defender, other Government Lawyers so appointed in the Department of Justice and Border Control or any other Government department approved by the Cabinet.

(2) The holding of such office under subsection (1) shall itself constitute admission of such person to practise as a legal practitioner in the Republic.

(3) The Minister in consultation with the Cabinet may where necessary establish positions of in house Government Lawyers in Government Departments.
