LEGAL PRACTITIONERS (AMENDMENT) ACT 1974

AN ACT

To amend the Legal Practitioners Act 1973.

(Certified: 20th February, 1974)

Enacted by the Parliament of Nauru as follows:

SHORT TITLE

1. This Act may be cited as the Legal Practitioners (Amendment) Act 1974.

INTERPRETATION

2 In this Act "the principal Act" means the Legal Practitioners Act 1973.

AMENDMENT TO SECTION 5 OF THE PRINCIPAL ACT

3. Section 5 of the principal Act is amended -

(a) by-deleting the words "advocate or law agent" and by inserting in lieu thereof the words "advocate, law agent or writer to the Signet";
(b) by deleting the word "or" next after the word "Scotland" and by inserting a comma in lieu thereof;
(c) by deleting the comma next after the word "Australia" and inserting the word "or" in lieu thereof;
(d) by deleting the words "or in any other country which may from time to time after consultation with the Chief Justice be notified by the Minister in the Gazette" and inserting in lieu thereof the words and punctuation "or as a barrister, solicitor, barrister and solicitor, advocate, attorney, proctor, counsel or other legal practitioner in any other country which may from time to time after consultation with the Chief Justice be notified by the Minister in the Gazette to practise in the Courts of that country;" and
(e) by adding to paragraph (a) the following proviso - "Provided that, where the Minister notifies any country in pursuance of this paragraph, he may, by the same notice or any subsequent notice in the Gazette, direct that, notwithstanding the other provisions of this section, admission in that country as a legal practitioner of any class specified in that notice is not to be qualification for admission as a barrister and solicitor in Nauru:"
