An Act to amend the Courts Act 1972 and the Family Court Act 1973 to extend the payment of fees and allowances to public officers who sit as lay magistrates and as members of the Family Court

Certified on 3 November 2011

Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Courts Legislation (Amendment) Act 2011.

2 Commencement

This Act commences on the day it is certified by the Speaker under Article 47.

3 Amendment of Acts

The Schedule amends the Acts mentioned in it.

SCHEDULE – AMENDMENT OF ACTS

section 3

Part 1 – Courts Act 1972

[1] Amendment of section 10

Section 10(8)

omit, substitute

(8) Each magistrate (other than the resident magistrate) must be paid the fees and allowances determined by the Minister by Gazette notice.

Part 2 – Family Court Act 1973

[2] Amendment of section 2

Section 2, definition of 'member'

omit, substitute

'member' means a member of the Family Court mentioned in section 4(1);

[3] Amendment of section 4

Section 4(3)

omit, substitute

(3) Each member (other than the resident magistrate) must be paid the fees and allowances determined by the Minister by Gazette notice.
