TRADITIONAL RIGHTS COURT (COMPOSITION AND APPOINTMENTS) (AMENDMENT) ACT 2014

AN ACT

To amend Subsection 303(2) of the Traditional Rights Court (Composition and Appointments) Act 1985, 27 MIRC Chp. 3, to provide that judges of the Traditional Rights Court shall hold office during good behavior for a term between 4 and 10 years, or until reaching the age of 72 years, whichever occurs first.

BE IT ENACTED BY THE NITIJELA OF THE MARSHALL ISLANDS:

Section 1. Short Title.

This Act may be cited as the Traditional Rights Court (Composition and Appointments) (Amendment) Act, 2014.

Section 2. Amendment.

Subsection 303(2) of the Traditional Rights Court (Composition and Appointments) Act 1985, 27 MIRC Chp.3, is amended to read as follows:

(2) The Chief Judge and Associate Judges of the permanent panel appointed under Subsection (1) shall hold office during good behavior for a term between four (4) and ten (10) years, or until reaching the age of 72 years, whichever first occurs.

Section 3. Transition Provision.

The above amendment shall apply to judges currently serving on the permanent panel of the Traditional Rights Court.

Section 4: Effective Date.

This Act shall take effect on the date of certification in accordance with Article IV, Section 21 of the Constitution and the Rules of Procedures of the Nitijela.
