NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS

JUDICIARY (COMMUNITY COURT TERM AND JURISDICTION AMENDMENT) ACT 2014


AN ACT


To amend Subsection 233(2) of the Judiciary Act 1983, 27 MIRC Chp. 2, to increase the term for Community Court judges from a term not exceeding 4 years to a term not exceeding 6 years or until reaching the age of 72 years, whichever first occurs; and to amend Subsection 234(2) of the Judiciary Act 1983 Chp. 2, to increase the civil jurisdiction of the Community Courts from $200 to $1,000.


BE IT ENACTED BY THE NITIJELA OF THE MARSHALL ISLANDS:


Section 1. Short Title.


This Act may be cited as the Judiciary (Community Court Term and Jurisdiction Amendment) Act, 2014.


Section 2. Amendments.


1. Amendment of Section 233(2) of the Judiciary Act 1983.


Subsection 233(2) of the Judiciary Act 1983, 27 MIRC Chp. 2, is amended to read as follows:


(2) A judge of a Community Court shall be appointed by the Judicial Service Commission for a term not exceeding six (6) years specified by the Commission, or until the judges reaches the age of 72 years, whichever first occurs, and may be removed from office by it for cause.


2. Amendment of Paragraph 234(2)(a) of the Judiciary Act 1983.


Paragraph 234(2)(a) of the Judiciary Act 1983, 27 MIRC Chp. 2, is amended to read as follows:


(2) A Community Court has original jurisdiction concurrently with the High Court and the District Court:


(a) in all civil cases (not including divorce, adoption or change of name), where the amount claimed or the value of the property involved does not exceed $1,000, except:


Section 3. Effective Date.


This Act shall take effect on the date of certification in accordance with Article IV, Section 21 of the Constitution.
