JUDICIAL COMPENSATION (AMENDMENT) ACT 2010

AN ACT

to amend the Judicial Compensation Act 1983.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1. Short Title.

This Act may be cited as the Judicial Compensation (Amendment) Act, 2010.

Section 2. Amendment.

(1) Section 404 of the Judicial Compensation Act 1983, 27 MIRC Chp. 4 is amended as set forth below:

§404. Suspension of Compensation.

(1) Notwithstanding anything to the contrary in this Chapter or any other law, the salary of a justice or judge shall be suspended:

(a) for a justice or judge of the High Court, Traditional Rights Court, District Court, or a Community Court, while any cause before the judge remains pending and undetermined for 45 days after it has been submitted for decision; and

(b) for a justice of the Supreme Court, while any cause before the justice or Supreme Court panel remains pending and undetermined for 120 days after it has been submitted for decision.

Section 3. Effective Date.

This Act shall take effect on the date of certification in accordance with Article IV, Section 21 of the Constitution and the Rules of Procedures of the Nitijela.
