AN ACT TO AMEND THE NATIONAL LOANS BOARD
ORDINANCE
(Cap. 59)

MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.

Short title

1. This Act may be cited as the National Loans Board (Amendment) Act 1984.

Amendment of section 3(2) of National Loans Board (Cap. 59)

2. The National Loans Board Ordinance (Cap. 59) (hereinafter referred to as the "Principal Ordinance") is hereby amended by repealing the words "subject to section 99 of the Constitution" wherever they occur in and throughout the Ordinance.

Amendment of section 7(1) Appointment of staff

3. Section 7(1) of the Principal Ordinance is hereby amended by repealing subsection (1) and substituting the following subsection and paragraphs:

"(1) (i) Without prejudice to any appointments already made under subsection (1) the Board shall after consultation with the Public Service Commission appoint an Executive Secretary.

(ii) The Board may from time to time establish such other posts (including that of Accountant) as it considers necessary and proper for the due and efficient administration, management and performance by the Board of its duties under the Principal Ordinance and shall acting in accordance with the advice of the Public Service Commission appoint staffs to fill those posts.

(iii) The termination of appointment, dismissal and disciplinary control of the staff including the Executive Secretary shall be vested in the Board acting in accordance with the advice of the Public Service Commission.

(iv) The Public Service Commission may with the prior approval in writing of the Board and of the Ministry concerned-

(a) second to any office; or

(b) approve the transfer,

of an officer from the service of the Board to the public service or from the public service to the service of the Board.

(v) The Board shall determine the level of salary or remuneration payable to any officer or staff within the service of the Board but in so determining the Board shall give due regard to and be guided by the salary structure and conditions as may from time to time be payable to public employees in the Public Service".

NATIONAL LOANS BOARD (AMENDMENT) ACT 1984

EXPLANATORY MEMORANDUM


The Act amends the National Loans Board Ordinance in two ways.

Firstly it repeals the words "subject to section 99 of the Constitution" wherever they occur throughout the Ordinance (Section 2). Such amendment enables the Minister to appoint members of the Board without reference to the Public Service Commission.

Secondly it repeals the existing Section 7(1) of the Ordinance which relates to the appointment of staffs of the Board. Presently the power to make such appointment is vested in the Minister. The amendment empowers the Board apart from the appointment of the Executive Secretary to appoint and remove staffs of the Board acting in accordance with the advice of the Public Service Commission and also to determine the level of salaries or remuneration of officers or staffs of the Board but must be guided by salary structures and conditions in the Public Service. (Section 3).
