Supreme Court (Amendment) Rules 1987

FIJI ISLANDS

SUPREME COURT ACT
(CHAPTER 13)

SUPREME COURT (AMENDMENT) RULES, 1987


IN exercise of the powers conferred upon me by Section 25(2) of the Supreme Court Act, I have made the following Rules -

Short title and commencement


1. These Rules may be cited as the Supreme Court (Amendment) Rules, 1987 and shall come into operation on 1 May, 1987.

Amendment of Order 53


2. Order 53 contained in Appendix 1 of the Supreme Court Rules is amended -

(a) by repealing paragraph (2) of Rule 3 and replacing it with the following -

“(2) An application for leave must be made ex parte to a Judge and must be supported-

(a) by a statement setting out the name and description of the applicant, the name and address of his barrister and solicitor (if any), the relief sought and the grounds upon which it is sought; and

(b) by an affidavit, to be filed before the application is made, verifying the facts relied on.”;

(b) in paragraph (3) of Rule 3, by inserting the words “or District” between the word “Principal” and the word “Registry” where it first occurs;

(c) in paragraph (2) of Rule 9, by inserting the words “or District” between the word “Principal” and the word “Registry”; and

(d) by repealing Rule 12.
