AN ACT

TO DEFER THE COMMENCEMENT OF THE PUBLIC FINANCE MANAGEMENT ACT 1999 AND TO MAKE MINOR AMENDMENTS TO IT

ENACTED by the Parliament of the Fiji Islands-

Short title etc

1.-(1) This Act may be cited as the Public Finance Management (Deferral and Amendment) Act 1999.

(2) In this Act, "principal Act" means the Public Finance Management Act 1999.

Deferral of commencement

2. Section 2 of the principal Act is amended-

(a) in subsection (1) by deleting "1^st January 2000" and substituting "the appointed day";

(b) in subsection (2) by deleting "the financial year commencing on 1^st January 1999" and substituting "any financial year commencing before the appointed day";

(c) in subsection (3) by deleting "1^st January 2000" and substituting "the appointed day";

(d) in subsection (4) by deleting everything after "in respect of" and substituting "a financial year commencing before the appointed day";

(e) by adding at the end the following new subsection-

"(5) In this section, "the appointed day" means the day appointed by the Minister by notice in the Gazette for commencement of this Act, which must be the first day of a financial year.".

Consequential amendments to principal Act

3. The section of the principal Act specified in column 1 of the Table are amended in the manner specified in column 2-

Minor amendments

4.-(1) Section 71 of the principal Act is amended in paragraph (1) by deleting "the respective" and substituting "they respectively".

(2) Schedule 13 of the principal Act is amended-

(a) in the item relating to "Cap 93 Rev 1985" by deleting "Fiji National Training Council Act" and substituting "Fiji National Training Act";

(b) by deleting the item relating to "Cap 150 Ed 1978";

(c) in the item relating to "Cap 206 Rev 1985" by deleting "Fiji Sugar Industry Commission Act" and substituting "Sugar Industry Act";

(d) in the item relating to "Cap 210 Rev 1995" by adding "Act" after "Reserve Bank of Fiji";

(e) in the item relating to "Cap 265 Ed 1978" by deleting "National Trust of Fiji Act" and substituting "National Trust for Fiji Act";

(f) in the item relating to "Cap 267 Rev 1985" by deleting "Housing Authority Act" and substituting "Housing Act";

(g) in the item relating to "1994 No 18" by adding "Act" after "National Road Safety Council";

(h) in the item relating to "1996 No 35"-

(i) by adding "1996" after "Public Enterprise Act"; and

(ii) by deleting the 13^th indent relating to Part 3 to 5;

(i) in the item relating to "1998 No 35" by deleting "Land Transport Authority Act 1998" and substituting "Land Transport Act 1998";

(j) in the item relating to "1998 No 48"-

(i) by deleting "Coconut Industry Development Act 1998" and substituting "Coconut Industry Development Authority Act 1998; and

(ii) by deleting the second indent relating to section 10(2);

(k) in the item relating to "1998 No 50" by deleting "Commerce Commission Act 1998" and substituting "Commerce Act 1998".

Consequential amendments to Public Service Act 1999

5.-(1) The Public Service Act 1999 is amended in section 3-

(a) by numbering it as subsection (1);

(b) in the definition of "chief executive" in subsection (1) by deleting "Bill" and substituting "Act";

(c) by adding the following new subsection-

"(2) in this Act until the day appointed for the commencement of the Public Finance Management Act 1999-

(a) a reference to a Purchase Minister is a reference to the Minister responsible for the administration of the department of Government concerned;

(b) a reference to an Ownership Minister is a reference to the Minister of Finance

(c) a reference to the Public Finance Management Act is a reference to that Act as if it came into force on the same date as this Act.".
