AN ACT

TO AMEND THE NATIONAL FIRE SERVICE ACT, 1994

ENACTED by the Parliament of Fiji.

Short title

1. This Act may be cited as the National Fire Service (Amendment) Act, 1997.

Interpretation

2. In this Act, the National Fire Service Act, 1994 is referred to as "principal Act".

Section '2' amended

3. Section "2" of the principal Act is amended by inserting the following definition immediately below the definition of "Authority":

"broker" means any person or corporation or company who exercises professional skills and is concerned with the placing of insurance business for commission, fee, allowance, return or otherwise,".

Section "32" amended

4. Section "32" of the principal Act is amended:

(a) in its heading by deleting "Individual Contribution" and substituting "Contribution";

(b) in subsection "(1)", by repealing it and substituting the following -

(1) "Every-

(a) person or corporation or company who places his or its insurance outside the Republic of Fiji by himself or by itself shall be liable to pay a contribution to the Authority based on the class of such insurance and the percentage rate applicable thereto as may be prescribed by the Minister;

(b) insurance company, insurance broker or agent who places insurance outside Fiji on behalf of any person, corporation or company shall be liable to pay such levy as prescribed under a levy order made by the Minister in accordance with Section 29 of this Act";

(c) in subsection "(3)", by inserting the words and expression "paragraph (a) or (b) of" immediately after the word "under" in the first line.

Section "33" amended

5. Section"33" of the principal Act is amended in subsection "(2)" by:-

(a) inserting the words, "broker or agent" immediately after the word "company" in the first line;

(b) deleting the words and expression "fifty-one" in the third line and substituting the words and expression "twenty-one"
