INDUSTRY EMBLEM


Act No. 29 of 1973.


AN ACT TO RESTRICT THE USE OF AN EMBLEM ON GOODS MANUFACTURED IN FIJI


[2nd November, 1973]


Short title


1. This Act may be cited as the Industry Emblem Act.


Restraint on use of emblem


2. No person shall, except with the written consent of the Minister, use, for any purpose whatsoever, the emblem shown in the Schedule, or anything so nearly or in any way resembling it as to be likely to deceive.


Rights not affected


3. Nothing in this Act shall affect the rights of any person registered prior to the 12th day of October, 1973, as the proprietor of a trade-mark in the Register of Trade Marks.


Penalty


4. Any person who contravenes the provisions of this Act shall be guilty of an offence and liable on conviction to a fine not exceeding one thousand dollars.


Acts committed outside Fiji


5. Any person who, being in Fiji, procures, counsels, aids, abets or is accessory to the commission outside Fiji of any act which, if committed in Fiji, would be an offence under this Act, shall be guilty of that offence as a principal and shall be liable to be proceeded against as if the offence had been committed in Fiji.
